Effective as of: March 1, 2026

Sweet Peas Rewards (“Sweet Peas Rewards,” the “Program”) is a rewards program operated by Sweet Peas Convenience Stores, Inc. and its affiliates, subsidiaries, and parent companies (collectively referred to as “Sweet Peas,” “we,” “us,” or “our”). Sweet Peas Rewards allows qualifying members to earn promotional rewards when purchasing eligible products at participating Sweet Peas locations.

These Sweet Peas Rewards Terms and Conditions (the “Terms”), together with any additional promotional terms we may publish, govern your access to and participation in the Program, as well as your use of our website(s), mobile applications, and digital services associated with Sweet Peas Rewards (collectively, the “Sweet Peas Rewards Sites”).

By enrolling in Sweet Peas Rewards, using your Sweet Peas Rewards Account or card, accessing or using the Sweet Peas Rewards Sites, or by clicking “I Agree,” you confirm that you understand and accept these Terms.
If you do not agree, you must discontinue participation in the Program.

1. Eligibility & Enrollment

There is no cost to join Sweet Peas Rewards.
To participate, you must:

• Be at least 18 years of age, and
• Be a legal U.S. resident.

Enrollment requires providing accurate registration information and agreeing to these Terms and our Privacy Policy.

(2) Modification of Agreement.  Company reserves the right, at its sole discretion, to change, modify, add or remove, cancel or otherwise alter any portion of this Agreement, in whole or in part, at any time.  This includes the right to apply such changes retroactively to Rewards (as hereinafter defined) already accrued. Notification of changes in the Agreement will be posted on the website designated in your mobile application (the “website”).  Use of the Program after such changes will be considered your agreement to be bound by any and all such changes.

3. Your Account

Once you enroll and provide a valid email address, a Sweet Peas Rewards Account (“Account”) will be created in your name. You must maintain accurate information and safeguard your account credentials.

You may only maintain one Account. Accounts are non-transferable and may not be shared or combined.

Sweet Peas may suspend or close your Account at any time for conduct inconsistent with these Terms, including fraud or misuse of the Program.

You may close your Account at any time by contacting rewards@sweetpeasstores.com. Any unredeemed Rewards will be forfeited upon closure.

4. Earning Rewards

Fuel Rewards

Members will earn $0.05 off per gallon of fuel (up to 20 gallons per redemption transaction) for every $25 spent on qualifying in-store purchases.

Qualifying Purchases

Rewards are earned on:

• Convenience merchandise
• Foodservice items
• Beverages (fountain, frozen, packaged)

Non-Qualifying Purchases

Rewards are not earned on purchases of:

• Fuel
• Alcohol
• Tobacco (including vaping products)
• Lottery
• Money orders
• Gift cards
• Prepaid cards (including phone/wireless)
• Sales tax or regulatory fees
• Car Wash

Special Promotional Offers

From time to time, Sweet Peas may run promotions offering additional Rewards. Those promotions will specify qualifying products and reward amounts.

5. Redeeming Fuel Rewards

• Rewards are redeemed only on fuel purchases.
• Each redemption applies to up to 20 gallons in a single fuel transaction.
• If fewer than 20 gallons are pumped, the remaining Reward value is forfeited.
• Rewards cannot reduce the fuel price below $0.02 per gallon.
• Rewards must be redeemed from the same Account in which they were earned.
• Rewards expire at the end of the month following the month they were earned.

Example: Rewards earned in March expire at the end of April.

6. Limitations

• Rewards are not cash, have no cash value, and are not property.
• Rewards may not be transferred, assigned, gifted, pledged, or sold.
• Rewards may not be redeemed for merchandise, cash, or credit.

7. Data & Privacy

By participating, you authorize Sweet Peas to collect and use data related to your purchases and account activity.
We may share this information for:

• Program operation and support,
• Personalization of offers,
• Market analysis and reporting,
• As otherwise described in our Privacy Policy.

8. Program Changes & Termination

Sweet Peas may modify or terminate the Program at any time.
Changes become effective upon posting the revised Terms.
Your continued participation means you accept any changes.

9. Disclaimers

SWEET PEAS PROVIDES THE PROGRAM “AS IS” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

10. LIMITATION OF COMPANY’S LIABILITY AND DAMAGES. IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY LOSS ARISING FROM LOST OR STOLEN PHONES / ACCOUNTS NOR FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY RELATED TO THE PROGRAM, THE REWARDS, THIS AGREEMENT, THE MOBILE APPLICATION, OR THE WEBSITE.  THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST POINTS, BUSINESS INTERRUPTION, DAMAGE TO EQUIPMENT, COMPUTER SYSTEMS OR PROGRAMS, OR ANY INFORMATION SYSTEM, OR THE LOSS OF ANY INFORMATION OR DATA.  THE MAXIMUM LIABILITY COLLECTIVELY OF THE COMPANY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) FOR ANY DAMAGES OF ANY NATURE, INCLUDING GROSS NEGLIGENCE, ARISING IN CONTRACT, TORT, OR OTHERWISE.
11. Indemnification

You agree to defend, indemnify, and hold harmless Sweet Peas, its affiliates, and employees from claims arising out of your misuse of the Program or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.

13. Arbitration & Class Action Waiver

EXCEPT FOR CLAIMS QUALIFYING FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING FROM OR RELATED TO THESE TERMS WILL BE RESOLVED BY BINDING ARBITRATION, NOT IN COURT.
CLASS ACTIONS AND CLASS ARBITRATIONS ARE NOT PERMITTED.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

14. Severability. The invalidity or unenforceability of any particular provision or provisions of this Agreement shall not affect any other provision or provisions hereof, and, if any one or more provisions of this Agreement shall be held invalid or unenforceable, the remainder of this Agreement shall be construed in all respects as if such invalid or unenforceable provision or provisions had been omitted.

15. Waiver. No provision hereof shall be waived except by an agreement in writing signed by the waiving party.  Further, a waiver of any term or provision shall not be construed as a waiver of any other term or provision.

16. Entire agreement. These terms and conditions and the privacy policy constitute 

the entire Agreement between Company and you with respect to your use of the Program.

17. Limitation on Commencement of a Cause of Action. Any cause of action you may have with respect to your use of the Program must be commenced within one (1) year after the claim or cause of action arises.

19. SMS/MMS Messaging Terms. By joining Sweet Peas Rewards, you authorize Sweet Peas to send you transactional text messages regarding offers and promotions at the telephone number you have provided. You are not required to enter into such an agreement in order to purchase any goods or services from Sweet Pea’s. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you.
